  1. A friend just sent me this article on pokernews.com, here is the link http://www.pokernews.com/news/2011/0...yers-10702.htm.

    This is the first that I have heard of this, what do you guys think? Here is a quote from the PPA from the linked article
    "In short, the PPA advises that a civil forfeiture claim probably isn't worth doing unless the player is trying to collect a large sum, even then there are concerns." So what qualifies as a large sum? The article says that after filing a claim you will need to get an attorney to help you through the process, so that is why the PPA says that it must be a large sum for someone to even consider filing the claim. Has anyone filed this claim?
     
  2. I've only read the PPA release but if I understood it correctly it wasn't so much a "large sum" but if you had a special kind of account where you had contact with ftp or ub and could classify your account in a different legal way.

    Other than that they mostly summarize that it will be difficult to get anything, and your main argument will be what the sites are going to argue (that online poker was never illegal) so if you win the sites will win too and paying the legal costs will be too much to be worth it.
  3. Thanks for the response fly44. Btw congrats on the great ranking, I remember seeing you post on pocket fives years ago and you always sounded like you knew what you were talking about. Sounds like not many people are going to file the claim if the PPA is pretty much advising against it. Anyone know of anyone who is filing the claim?

  4. I filed a claim
    I sent it to my lawyer, and sent him the PPA link. He said it was ridiculous and there can be no harm in at least getting a claim in.
    I sent it today fedex to the court and copied where i needed to copy
     
  5. What if we all hired the same firm / lawyer and paid them a % of our BR's as payment?...i have no clue if that is even possible, just a random thought...

  7. I was also going to ask if anyone filed a claim. The PPA has said that it requires an attorney, which potentially means a large out-of-pocket expense for a payout that isn't guaranteed.

    i filed a claim, it cost me nothing. I do have many attorneys in my family, and showed it to one of them, who said all i need to do is put the information into the form and send it in.
    No offense to the PPA, but I disagree with their assesment and certainly their recommendation that people do not file claims. Its too late now.
    I also do not think they handled the matter in the best way, putting out their 'notice' 24 hours (or was it 48, either way) before the deadline. Not like most people had time to react.
    I will keep everyone informed on all communications I get from the courts.

    The decision as to whether to file a claim of not is an individual one and the PPA was not and is not trying to tell anyone whether they should or should not have filed. The PPA (even if it thought it was a good idea) could not file claims on everyone's behalf for a large variety of legal reasons. So instead the PPA published the information guide so everyone could make up their own mind as to the best way to protect their individual interests.

    I do you hope you have the guide and read more than just the sample claim form that was supplied, isuck123. The claim form was pretty simple - but the next step is not. You now have 21 days in which to file a formal "answer" to the Government's petition for forfeiture. This answer must comply with the Federal Rules of Civil Procedure. The PPA is not even going to try and give a short course on the Federal Rules of Civil Procedure. That is usually a 6 month to 1 year course taught in Law School.

    Filing the answer is where the PPA strongly suggests you will need a lawyer or have substantial legal training yourself. If you do not file the answer your claim will be dismissed. If you insist on going about this without a a lawyer, start studying.

  10. thanks for your opinion. I must ask why if PPA was concerned about this, they put out the informaton only 48 hours prior to the deadline?
    as far as my case goes, I will keep everyone here informed, and considering I have a legal background, although not an attorney, and my sister and uncle are practicing attorneys, I do not expect to have a problem with any filings or paperwork.
