Here is my thoughts on how i think this will all go down. When the bill was passed not allowing US companies to take or give money from gambling sites, PS, FT and others went out to find other places (off shore) to get around the new law. The one that was run by Daniel Tzvetkoff which started this whole thing off is just one of many off shore sites that took and gave money from and to players. In Canada I use CCBill and it is a perfectly legitimate site. What Mr. Tzvetkoff did was to create hundreds of false companies to hide the money, where it came from and where it was going, and if one got shut down the liability lost from that company was minimal as no company individually was worth a lot of money. This is why I believe you hear people saying "My check bounced from XXXX" then they get another and all was okay.
The DoJ I believe will attempt to confiscate the amount of money they can prove came from Mr. Tzvetkof's businesses but they won't be able to touch the other money PS, FT and AP had from legitimate and legal offshore accounts. I believe that PS, FT and AP will have to eat those losses, pay fines, ect. Their remaining assets should still be theirs and if people want to withdraw, even to US residents, they should make a deal with the DoJ to get that money back to them and I think over the upcoming months it will be made possible with the understanding that in the future these sites must BLOCK all US players from playing on their sites.
The caveat is this, which poker sites can absorb such a hit financially. Tom Dwan is posting that he believes PS and FT can handle the hit but places like AP will struggle. He believes that people will eventually get their money if they wish to withdraw but it may take months as all this is sorted out.
I also believe that this is the pre-cursor to the US Gov of eventually allowing online gambling in the US but will work to come up with a way of being able to tax it, most likely taking a % of every raked hand or every tournament. It is also possible that after they finish this they will go after the other card rooms and attempt to shut it down completely. In Canada, provinces are starting up online gambling/ poker sites that you can ONLY access if you live in that province, thus it is a provincial issue and not a federal one.
Either way it should be very interesting to watch how things play out after this. -
