  1. When i was driving home yesterday i got caught between two semi rig trucks doing an oil rig move. A very large and heavy chunck of metal flew off the back of the semi i was following behind and smashed into the passenger side of my truck, which caused considerable damage and put me in the ditch. So when the police showed up and got there info they told me that the company is being charged and that if i want to pursue this further beyond the means of just insurance i can.

    As i write this my truck is at the impound and i cant get ahold of my insurance company until monday....(WTF) so im just wondering since im a newb at getting into car accidents how much money is this going to cost me? the tow was 170$ pluse 150 fee for every day at the impound and my deductible is 500$ (which im not sure if i got to pay or not). Iam currently doing my last 3 months of school and just had a baby 5 weeks ago so i really cant afford this shit right now least of all a lawyer.............oh well least im not hurt i guess. Thanks for the advice/info in advance
  2. Well considering it was not your fault, why would you be worried about paying the deductible? You only pay that if the accident was YOUR fault. The insurance company of the oil rig company should be paying for the Tow Charges, impound charges, and the repairs to your vehicle. Should cost you NOTHING.

    Your insurance company can take care of all this Monday.

  5. Why is your vehicle in the impound? Or do you mean the storage yard the tow company has? Next time have an Auto Body Shop in mind when your car gets towed. Tow company's love to rape people when it comes to towing your vehicle and storing it in their "secure" lot. Never let them take your car back to their lot if you can prevent it, the storage fee adds up quickly. As you can probably imagine.

    You should check to see if you have towing on your policy, and a rental car. If you dont have an alternate vehicle. Most people dont realize how lacking their insurance policy is until they get into a wreck. Only time you pay a deductible would be if they were uninsured or it was your fault and your insurance company is paying the bill. Seeing how it was a company that caused your wreck you should turn out just fine..

    But you should not even need to contact them. You need to contact the truck company's insurance carrier and report the claim. They should pay to have your truck towed to the repair shop of your choice, so figure out what shop you want to use and tell them to take your car there. They (the truck's insurance carrier) will send their rep out to do an estimate and the shop will do an estimate and you will get you truck fixed, including any hidden damage or supplemental repairs. You should get a rental vehicle while your truck is getting repaired. All of this assumes that liability rests with the truck that lost the piece of metal. My guess is that they will say that it just popped up from the road, so you should see if you can find out what it was that hit your truck and trace it to the trucks cargo.

    If they contest liability then report it to your insurance company. You may have to pay your deductible up front, but then your insurance will pay to fix your truck and will then proceed against the other company. They will have an intercompany arbitration and if your company wins you will be reimbursed your deductible.

    The short answer is that it should cost you nothing except inconvenience if the trucking company is at fault.
  7. I would also recommend getting a copy of the police report charging the trucking company, and definitely call your insurance company on Monday, just so there are no surprises on that end. Insurance companies HATE surprises. Otherwise, previous comments are pretty much bang on . . . this should not cost you a dime. Go for a free rental, as well, if you need a vehicle before yours is repaired.
