So one of my best friends from home (29 years old) He works 60 hours a week (makes about 60k a year) and is finishing up his 2nd major in school at the same time.. Pretty good kid, got in trouble for a few dumb things when he was younger like drinking in public and running from the cops when he was like 19 or 20... but nothing in the last 9 years or so.... So anyways, he works on bridges for a living, went to Home Depot and bought some stuff paid with a $100.00 bill, bought like $50.00 worth of stuff.. So then he goes to Mcdonalds, gets some food, pays with a $20.00 bill that he just got back as change, the manager behind the counter looks at the bill and says this kind of looks fake, my friend asks to see it back, and a direct quote "It looks good to me, who checks $20's anyways?" So the dude just gives him the food, as he's driving off, he uses one of those felt pens and sees it's fake, the Mcdonalds guy writes down his plates and calls the cops.... by the time he gets home there are 3 police cars waiting for him.... They take him into custody and bring him to the station....
He gets to the police station (This is obv a small town btw, where nothing ever happens, so the cops are all over this) They start grilling him thinking he's like the mastermind behind making fake counterfeit bills (There has been a few of them going around the small town lately I guess), my friend just starts getting mad, basically calling the cops stupid and to go to Home Depot etc, it was just wrong place wrong time kinda shit.. The cops don't care at all, and are totally trying to throw the book at him..The next day he's on the front page of the newspaper ( He's the link if anyone wants to read it. http://www.eagletribune.com/punewshh...yword=topstory and once again, we live in a Small town, he's basically the talk of the town now, which basically means he stands no chance at ever getting a job ever again around there, and might lose his job now because of this....
They are charging him with "Uttering a counterfeit note" and basically trying to throw the book at him, and are working on more charges...... I guess it's a pretty serious charge, and even though it seems like total common sense that he didn't make the counterfeit bill, and obviously didn't know he had one....(I'm 100% sure if they thought he was "Making these bills", they would have raided his house looking for shit.. which they didn't which obviously means they are just trying to be dicks about it all) they are trying to make an example out of him for whatever reason, because it's a small town and they have nothing better to do.... So his family is telling him to get a lawyer, which every lawyer said they wanted between 4-5k to take on the case... What's your play here? Just one of those shitty things that really could happen to anyone... and unfortunately these cops just have it out for him.....
Edit: I just found out he tried to have the police give him a polygraph test (they actually have a polygraph test there too I guess), and they refused saying it's not admissible in court, so what's the point.... He said "Because it will prove to you I didn't do it" and they said "Well people can beat it so that means nothing" What a joke... -
Wow that sucks. It's not like he's doing it on purpose. Once they go through his house and stuff they'll have no evidence.

That's the problem, is they arn't going through his house.... I mean it's pretty obvious a 29 year old kid, who makes 60k a year works 60 hours a week, and goes to college to work on a 2nd major, (and trust me is not the computer type) isn't doing this, but he was a punk kid 9 years ago, it's still the same cops in the small town 9 years later that never liked him and are trying to get him for whatever they can... But like I said, if they thought he did it, they cops and feds prob would have been searching his place in 5 minutes..... They are just trying to be dicks...

If that's the case and the charges get dropped, I hope your friend sues for harassment and improper treatment. I'm sure he can get something because the cops sure seem like they did the whole thing improperly.

lol so they were waiting at his house to arrest him but then never bother to get a search warrant and look for any type of counterfeiting equipment/evidence?

But that's the big question, is does he pay 5k for a lawyer, for a case which seems basically common sense that he didn't do, but if he shows up without one, could get totally fucked since he really has no clue what's going down... If this was a city, I'd say just go in without one, but this is small town America, where basically everything is kinda corrupt, between the cops and judges prob have each other over for dinner after the trial is over

some of my friends had fake 20's passed to them at a kegger at their house some years ago. No big deal, taken in, questioned, comps taken and the like, the cops had nothing to charge them with. Without any proof, and only 1 fake bill to work with, any reasonable judge would throw this right out. Public defender would be competent too.

Well, that's why I through that in there... but at the same time he REALLY didn't think it was counterfeit and just wanted his damn food... in hindsight it looks stupid.. but if you don't really think you did anything wrong, you don't really care what you say.. you just want your damn food lol

Seriously, this. I don't see how he's even remotely in jeopardy of actually getting charged. Maybe they're just trying to scare him into confessing something.

Well, the main problem is right now they are trying to charge him with knowingly using a 20.00 bill (while they are working on other charges as well I guess) and that's why I threw that part about what he said in there, because he unfortunately said, "who check's 20's anyways" it somewhat makes him seem a little guilty.. like I said, it sounds stupid at the time, but if you really don't think you have a counterfeit bill, and think you are doing nothing wrong and some 6.00 an hour employee is basically saying you're passing out fake money, you might get a little snappy too... Obviously he handled it wrong, and he knows it, but like I said, if you didn't think you're doing anything wrong... then I guess you don't really care what you say...

Exactly... and in a Small town area, where everyone knows everyone, and this is obviously the talk of the town....this kids life is basically ruined, because the cops simply just wanna be dicks..

I would still hire an attorney but this is a very difficult charge for a prosecutor to prove up.
To be found guilty of uttering the accused has to have passed or attempted to pass a counterfeit Federal Reserve note. The accused must have known at that time that the note was fake and that the person passed the fake note willingly and with the intent to defraud. -
Make a citizen's arrest on Home Depot.

I hear ya, it's just one of those things, where if I was him, personally, I'd much rather take that $5,000 that I worked my ass off for, and go to Hawaii for two weeks, instead of paying it to a lawyer for basically a ton of nonsense that he should never be getting charged for.....Just a tough call......

Obv it's the local policemen who are making the fake currensy and they are trying to pin it on your friend who has a rap sheet. This will take the heat off of other suspects (them) and allow the pressure on their department to settle.
If I were him I would stakeout the policemen inbetween work and school and see which one of them has most recently made any home improvements like a new mailbox or such, then get someone else (since they know what he looks like) to ask him for change for a $100 at a gas station or something and then take the fake 20's he gave them to some trusted authorities. -
Just have Aunt Bea bake an apple pie for him to give the judge; Opie can bring it over - everyone loves that freckly little rascal!

I would be willing to bet that the Secret Service probably already has a good idea where the money came from. The local cops and prosecutor will in all likelihood not be handling this case. Still the best advice is to get lawyer. Tough break.

Damn that is such a lame situation. How can you charge someone with counterfeiting unless you have tons of evidence they are doing so? I mean the whole point of counterfeiting is to swap out fake money with real money over time, so if someone is successful in doing so there are always going to be innocent people with fake money who shouldn't get in trouble.
