So a report has come out the Stallworth BAC was .12 during the time of the crash. Can someone explain how he was not taken to jail that day and charged with something? There have been no charges filed as of yet against him.
It seems in cases involving DUI, they take a breathlyzer, if your over they take you to jail and book you then take blood.
Were not talking borderline here either, he was .12. Could he have been given a breathlyzer that day but passed? -

They drew blood at the scene
Blood Test > Breathalyzer -
this makes no sense at all, even if Donte Stallworth tried to kill his wife there is like a 95% chance he'd pull his hamstring in the process and have to wait 4-6 weeks to make an attempt on her life again.

If the guy is being cooperative in a case like this i dont' see why you don't just immead. do a blood test considering it's much more conclusive. Breathalyzers are a waste of time. Anyone with a reasonable amount of money can always beat those in court.

why don't you get back to hating on ppl for getting laid instead of making reposts?
they obv took him in to the station, detained him, and gave him a blood test...
let's assume the cops at the scene are not sure whether he was at fault in the wreck...
it was 7am and if they could not smell alcohol, and/or if he passed a field sobriety test at the scene, they had nothing to hold him on, pending investigation of the accident... so they realease him, wait for the results, and now they will arrest him again you can bet your ass on that... -
He had a BAC of .12 and they could not smell the alcohol?! I'd like to know what cologne/gum/eye drops he is using.

I don't know if they took him to the station. Maybe your right, maybe he passed all tests in the field and they let him go. Seems odd to me considering he killed a man with his car. I always thought they gave you a breathalyzer and it showed above the limit, they took you to the station and then got blood drawn.

Any OTer that has been driving at 8 Am after a night of binge drinking has prob been driving with a .12 FWIW.
.12 really isn't that much

Just another classic example of how bastardized "justice" is in this country.
The rich, the sons and daughters of the rich, celebrities, high-profile athletes and any and all other "famous" people get every break in the friggin world when it comes to answering for their crimes.
Ordinary people spend weeks and sometimes months in jail for the same or similar crimes before they even get a friggin hearing on their charges and then when they go up before a judge they get "the max" for fine/jail time.

Section 316.1933, Florida Statutes (1997), reads in pertinent part:- 316.1933 Blood Test for Impairment or Intoxication in Cases of Death or Serious Bodily Injury; Right to Use Reasonable Force
(1) Notwithstanding any recognized ability to refuse to submit to the tests provided in s. 316.1932 or any recognized power to revoke the implied consent to such tests, if a law enforcement officer has probable cause to believe that a motor vehicle driven by or in the actual physical control of a person under the influence of alcoholic beverages . . . has caused the death or serious bodily injury of a human being, such person shall submit, upon the request of a law enforcement officer to a test of the person's blood for the purpose of determining the alcoholic content thereof . . . The law enforcement officer may use reasonable force if necessary to require such person to submit to the administration of the blood test . . .
