    If I remember correctly, the burden of truth is pretty high in libel cases, so even the picture of the baby could be construed as false. Basically, he is saying that that's what his baby would have looked like, but obviously that's an exaggeration, and I think that would be grounds enough for libel.

    It isn't an exaggeration if all that is there is a black placeholder for the baby is it? Isn't it just supposed to be symbolism? Or am I not seeing the billboard correctly?

    Honestly, it's probably a matter of interpretation and how skilled your lawyer would be. I'm actually interested in this, and if there are any actual lawyers in OT(not law school applicant aka fakers like me) it would be cool if they would let us know how strong a libel case would be in this situation.

    I think the issue is that there is no proof that the girl actually had an abortion or just a miscarriage.

    Pretty sure that could be proven. I mean if she wanted to sue for libel wouldn't she have to allow her medical records in regards to the pregnancy be allowed into court for the purposes of deciding libel?
