Ok, so I have a credit card at Bank of America. I've had it for 3 months.
My due date is the 5th of every month, but I get money every month on the 15th. So what I've been doing (for this card and EVERY card I've ever had) is just making my payments on the 15th or 16th every month that way I don't accidently spend what was meant for a CC payment. I've been doing this with other cards for 3 years and have never, EVER had a problem.
For the month of December, my due date was the 5th. I made my payment on November 17th, and everything was fine. Fast forward to the statement due on Jan 5th. I made this payment on the 15th (it was 10x the min payment, cutting the amount owed in half). I went along assumig all was good.
Today, I go look at my statement online getting ready to pay for the month of Feb. Turns out, I have a late fee for Jan, and it says I have not made a payment yet. I'm confused, thinking it's just a misunderstanding. I get on the phone with the representative and am informed that "Since the payment in December (for Jan) was made prior to the closing date of the statement, it was credited to my December statement and will not count as a payment for my Jan due date". I am now 10 days overdue, have to make a payment for Jan, AND for Feb as well. She also said that she can't waive the fee.
Despite me trying to explain to this cuntbag (Conversation started as "Hi, I was looking online and noticed a late fee when I paid in December" "Oh, well it doesnt count. I cant do anything. Anything else?" ... when asked if there was anyone else I could talk to, the reply was "I'm in charge of the account so you can talk to me") that CLEARLY since there are Two Separate large (in terms of ratio to min payment) payments - one at the very beginning of the statement and one that apparently was on the last day - that one was meant for the Jan due date, she insisted that she can't do anything as I havn't made a payment for Jan and I need to do so ASAP.
So now I have to go to the actual branch I frequent and inform them that there will be no further business with them. Which sucks because it's so convienient.

Most of these tpyes of stories are best resolved by being friendly. Go in person, don't lose your temper and don't be beligerant. They have the upper hand in a sense, but also don't want to lose you. They are going to push you as far as they can.
Do not leave without getting hte late fees waived. They can do that no problem.
All these companies suck. You just had to suck it up sometimes and be nice to them. -
Unfortunately, they're right. You made a payment before the statement period closed. I've done it before and it sucks.
One thing you can do: Call them back, and have them change your due date to the 25th of each month. They should be able to do this - I did this with my Citi card after the same thing happened. -
Try taking in a business check that you deposited in your business account at another bank. It was returned due to NSF (BofA company written to yours) and then taking it in a BofA branch. Cannot be given as cash, will only convert it to a MO/cashier check and also with a nasty fee on top of it. F EM! Yes, this is similar at other banks but normally a short 5 minute conversation with a branch manager easily removes the fees and you get your money and can leave happily.

Close credit card and transfer to another bank. If you use B of A for general banking, close those accounts and move elsehwere as well.

Yup all you can do is say FU BOFA and go to the 2nd closest bank :D. It's what banks hate the most, losing your money and accounts especially credit cards. BTW. I read the entire story first before I read the cliff notes.

hi this is cleeshay, i was just on the phone with a representative that was assiting me with my account,
rep will ask what is it, you say she was going to credit my account because of an automated banking error, the system defaulted my payment to the previous month when it was supposed to clear this month.. rep will look at account, be nice hows the weather?

rep will return , and say sir the notes on here say this, you say what! she said she would credit my account and she put me on hold to talk to a manger, this is absurd can i speak to your manager?
rep will say sure, put you on hold ..
look at her c0-worker and say this nugguah thinks he slick watch im catch him.
shell come back and say sorry sir no manager available,
you say great can i have your employee ID, and yes thank you ill hold for a manger..
you'll be on hold for a few minutes she'll come back and say sir ive gotten you a 1 time courtesy well waive the fee, make sure you make your payment before your cycle date.
easy.. just takes a little while,

I'm so mad I just may stop making my mortgage payment, which goes to BofA after the other two companies folded....
But seriously, I'd try speaking to a manager and explain the situation. If, for whatever reason, they refuse to waive the fees then close all accounts associated with them and tell them to go suck Obama's dong for more bailout money. -
Why dont you just change your payment date, your bank will not have any problem with that.

Did you call BofA, or did you call the customer service number on the back of the card? Yes, they are different numbers, different people, etc. I would call the one you haven't yet and explain the situation. In my experience, the credit card reps tend to be more friendly and helpful than the bank reps.
Remember to be as friendly and concise as possible. The person you are talking to didn't do anything to fuck you over (yet), so you have nothing to be pissed off at them about. They also probably don't enjoy having the same conversation repeated with 100 people throughout the day, so it's also likely that they will appreciate you keeping the call brief. -
they wont care dude. you're just another drop in the bucket. save your breath and use the 800 #'s like others in this thread suggest. being calm and friendly will get you a lot further than you think. being a dick is a sure fire way to ensure they don't credit the fee.

Any time I don't get what I want out of a CSR, I ask who I should speak to to close my account. Sometimes I do this as a (zero risk) bluff. Sometimes it works. Always be calm and courteous, because at the end of the day, at least you aren't a person who works in a fucking call center.

Yes BOA is a POS. I have a card with them and couldn't get my online account to work. I called 3 or 4 times, taking about 3 hours of my time trying to get it to work. I finally gave up and the ho gave her sales pitch asking if I wanted to try protection plus at no cost. Sure why not. Well after 30 days they started charging me for it. I called and told them to cancel it. The next bill it still wasn't canceled, so with that charge I went over my limit, because they didn't even bill me enough to keep it under my limit. Now they tack on another $40 fee.
I called and explained it an they said they wouldn't waive the fee. In the end I said screw them and just quit paying. Now they call 20 times a week and I just turn the ringer off. Eventually if they want payed they will waive the fee I guess. Till then they can write it off since they just got a 25 billion $ bail out.
You can call 1-800-553-0231. If they don't help you, ask for a supervisor. Thats what I was told in a call from FIA. I haven't tried it yet. -
so to sum up:
you have no control over your own spending habits such that you don't trust yourself to keep money in an account for a few more days that you need in order to pay a bill
you paid on your credit card prior to billing cycle ending and are upset that they treated it as a balance paydown as opposed to the next month's payment
now you're really upset because you contact the call center and are apparently surprised that you got a low-minded CSR who wouldn't do what you wanted
want to bitch instead of just making a min payment to satisfy Jan's payment, and then going into branch and probably getting the fee taken care of for you there
