WASHINGTON, Feb. 25, 2009—
The Obama administration will seek to reinstate the assault weapons ban that expired in 2004 during the Bush administration, Attorney General Eric Holder said today.
"As President Obama indicated during the campaign, there are just a few gun-related changes that we would like to make, and among them would be to reinstitute the ban on the sale of assault weapons," Holder told reporters.
Holder said that putting the ban back in place would not only be a positive move by the United States, it would help cut down on the flow of guns going across the border into Mexico, which is struggling with heavy violence among drug cartels along the border.
"I think that will have a positive impact in Mexico, at a minimum." Holder said at a news conference on the arrest of more than 700 people in a drug enforcement crackdown on Mexican drug cartels operating in the U.S.
Mexican government officials have complained that the availability of sophisticated guns from the United States have emboldened drug traffickers to fight over access routes into the U.S.
A State Department travel warning issued Feb. 20, 2009, reflected government concerns about the violence.
"Some recent Mexican army and police confrontations with drug cartels have resembled small-unit combat, with cartels employing automatic weapons and grenades," the warning said. "Large firefights have taken place in many towns and cities across Mexico, but most recently in northern Mexico, including Tijuana, Chihuahua City and Ciudad Juarez."
At the news conference today, Holder described his discussions with his Mexican counterpart about the recent spike in violence.
"I met yesterday with Attorney General Medina Mora of Mexico, and we discussed the unprecedented levels of violence his country is facing because of their enforcement efforts," he said.
Holder declined to offer any time frame for the reimplementation of the assault weapons ban, however.
"It's something, as I said, that the president talked about during the campaign," he said. "There are obviously a number of things that are -- that have been taking up a substantial amount of his time, and so, I'm not sure exactly what the sequencing will be."
In a brief interview with ABC News, Wayne LaPierre, president of the National Rifle Association, said, "I think there are a lot of Democrats on Capitol Hill cringing at Eric Holder's comments right now."
During his confirmation hearing, Holder told the Senate Judiciary Committee about other gun control measures the Obama administration may consider.
"I think closing the gun show loophole, the banning of cop-killer bullets and I also think that making the assault weapons ban permanent, would be something that would be permitted under Heller," Holder said, referring to the Supreme Court ruling in Washington, D.C. v. Heller, which asserted the Second Amendment as an individual's right to own a weapon.
The Assault Weapons Ban signed into law by President Clinton in 1994 banned 19 types of semi-automatic military-style guns and ammunition clips with more than 10 rounds.
"A semi-automatic is a quintessential self-defense firearm owned by American citizens in this country," LaPierre said. "I think it is clearly covered under Heller and it's clearly, I think, protected by the Constitution."

Most people knew this ban was coming as evidence by gun sales lately but what are your guy's opinions on this type of gun control?
I personally am against all forms of gun control except laws preventing violent felons from owning firearms. -
I'm all for the 2nd amendment but the legal sales of assault weapons is just ridiculous and has to go.

wouldn't this also ban weapons that are legitimately problematic like ones with big clips, automatic weapons, and burst firing weapons? Or are those bant under some different law? -
Right, because the U.S. is the ONLY place they can get these weapons...

I'm sure the Obama administration's main concern in regards to assault weapons, is the safety of the Mexican authorities and their problems with drug trafficing in THEIR country! -
Not exactly. The previous AWB did ban high capacity magazines and features on AR type rifles (yes, there is more beyond this but I will keep it brief).

"Automatic weapons" as you listed are generally what one refers to with full-auto type firing and is initially covered under the NFA 1934 (National Firearms Act of 1934). This regulation would cover machine guns, short barrel rifles, shortened shotguns, silencers and supressors.
I can elaborate further on the Gun Control Act of 1968 for those that are interested in this subject matter.
Obtaining Class 3 items are a very different animal than the process of purchasing a semi-auto pistol or rifle. -
i guess in the world i imagine that would be a petty crime unless you did something like stomp the guy's head in a few times while hes already knocked out, so no i mean violent felons like home invaders, rapists, armes robbers, i guess mostly people who have been convicted of committing violent crimes with a firearm.

obv i am not for people having nukes but that is not what they want to ban here, these guys want to ban semi automatic rifles that shoot one shot per trigger pull when there is no evidence that it will serve the american people in any way.
I mean here we are bailing out all sorts of banks that have been robbing us for years, talking about nationalizing industries, redistributing wealth, rationing health care, all sorts of wars, and now they want pass more gun laws. this just gives me a sick feeling. -
I know thats not what this specific potential bill is about, but I'm wondering where you (and other OT second amendment supporters) would draw the line and how you justify that line.

the only thing positive i take from this is the gun show loophole. im sure a ton of people get guns that way who cant normally get them than any other method... and by 'cant normally get them' i mean people who were already deemed unworthy of owning one. if you CAN buy one then you should be able to buy one obv.
honestly, some guy on a corner with a hot gun he just stole is more of an issue but you do hear of crimes that come from this gun show loophole.

i cant recall the last assault rifle crime wave afflicting normal citizens that came through but theres probably someone IN AMERICA (not mexico) and god knows we must ban something to protect that one person who is part of a crime organization from killing another member of a crime organization lol. but mostly we must protect everyone from their OWN STUPIDITY right? (if you dont know i am not serious diagf.) -
On the plus side this is going to make several of my friends quite wealthy. They have been buying up these guns in anticipation of just this move. ka-ching.

Drawing the line on which guns are acceptable for the general public to purchase, and which guns aren't is similar to drawing the line on which cars are street-legal and which cars are not. Neither are an exact science, but both are roughly doable.

In general though, if the stuff your gun shoots doesn't explode, and the ammo it shoots is widely mass produced, and the gun only shoots one cartridge per trigger pull, it should probably be ok. -

To me since the purpose of the 2nd is allow the people to raise a militia I think fully automatic weapons and grenades, and cannons, all of which can be built if one wanted to bad enough anyway.
my problem is that there really is no gun show loophole, if you go to a gunshow and guy a gun from a FFL you go through the normal procedure, but in for example North Carolina you can buy a rifle or a shotgun from an individual without exchanging paperwork or performing a background check.Originally Posted by skisteve

So basically they want to make it a crime for an individual to sell his property to another individual. Only dealers around here have to perform background checks , its is still illegal for a felon to possess a fireaarm though. -
