  1. got a ticket for 62 in a 45 on my way back to maryland from charles town, wv. This is 5 points for WVU so obviously going to fight it and hopefully get it dropped to a lesser charge or maybe just dropped altogether. Looking for advice from people who have successfully gotten tickets dropped/lowered without using a lawyer. The cop told me he'd help me get it lowered and said to call the court during the week and tell them my intention to fight it bla bla bla but this sounds like a trap to me and would simply let the court arrange for the police officer to show up so I'm not doing that unless there's something I'm missing.

    Specifically to people in West Virginia, I was reading about a law where radar gun evidence can only be used in Class I, II, or III municipalities, not Class IV municipalities (having less than 2000 residents at the last US census). I got the ticket in Harpers Ferry, WV which has a population of 300 so can I just go in and cite the law/whatever and ask for radar evidence to be thrown out? Court date is May 4th so plenty of time to figure out the game plan. Any and all advice appreciated.

  3. This is one of those things that just tilt me to no end. Just pay your ticket. Man up. What are you going to fight exactly? That you weren't speeding. The radar gun is like the one at oakland coliseum? ( fast) You did the crime pay your fine and move on.
  4. i would guess that just showing up for the court appearance and going up to the prosecutors when they call ur name, they will snap reduce it to some degree. (if traffic court there is anything like traffic court in NY).

  6. lol speeding laws are absurd, simply designed to generate revenue. at least make them reasonable. 55mph? are you kidding me? anyone see that video of the people that lined up 4 cars across all the lanes and drove 55mph and held up the entire freeway? anyway...to the op, if that law is real el oh el, wp i would deff. try to get that through. talk to a lawyer though that's really the only advice that will work.

    ive had 3 or 4 tickets dropped aka nollied from just pleading not guilty on the back of the ticket, totaling over 1k in fines by just signing not guilty

    if the court has too many tickets on their hands they just auto nolly many of them

    ive also had numerous other tickets reduced by 40% just by showing up to court

    yes i like to drive fast

  12. i find it funny that a lot of OTers tend to take the high ground when dealing with speeding tickets. i've made two speeding ticket threads and got many similar comments. come to think of it, maybe they were afink too...
     
  13. also to the op I'm not sure what to say.. if you have a good personality try to be funny about the situation while being extremely respectful. obv dress nicely, try to look vulnerable if that makes any sense lol

    the one ticket that got dropped was one of the worst I have got ($300+ fine).. I had the judge laughing pretty hard and before he said what the deal was he said "I can tell youre an extremely good kid" I just tried to act dumb and innocent, it apparently worked

  14. Well if 5 Pts is a shit to of pts on your license. Maybe you shouldnt be fucking speeding then perhaps.. Why are my comments ignorant? Because I take accountability for my actions when I fuck up.. What exactly do you say to the judge when you fight these tickets? Are you proud of yourself that you break the law time after time and there are no consequences.. Where do you draw the line? Why dont you get hammered and drive as well and kill someone like what happened to a good friend of mine. Should that person get let off as well? At what point do you say exactly maybe I shouldnt break the law anymore.

    And ive received plenty of speeding tickets in plenty of states.. And ive paid every one of them.. How smart is it to take a day off from work lose 200 bucks in pay to fight a 180 dollar ticket? Not too bright I dont think. And if you plead no contest and pay your ticket there are no points against your license and it doesnt get reported to insurance.. The only time ive ever had an traffic report that affected my insurance was when a cop pulled me over cause I was speeding. Was as you put it a cool guy and only gave me a ticket for failure to drive right and the fine was only like 70 bucks. But that charge was reported to my insurance and it went up.. Thanks.


    And yes ive watched Law Abiding Citizen way too much the last year and I think everyone should be held accountable for their actions. So yes im the most ignorant person on here because I actually have a little integrity and admit when I make a mistake and dont go crying to a judge please let me off sir I wont do it again.

  18. In no way shape or form is Drunk Driving and Speeding the same... I speed every day and never drink and drive... I have had 10 or so speeding tickets(none in last 7 years) but never had a DUI or ever will.

  21. I don't think Afinks comments are ignorant but I also say go for it if you have a chance of ticket getting reduced. In Texas, you aren't getting it reduced unless the officer doesn't show up to court.
     
  22. What I've been told works the best is just show up to court and talk to the officer beforehand. Tell them you're not trying to deny it you are just hoping to get it reduced and you know what you did was wrong. I've never been to traffic court but apparently just going there and being like ya I messed up actually gives you a good shot at having a ticket reduced to a smaller one or even just a fine.

    well ppl that get in accidents that are like 5% over the speed limit pry help make up this stat, there are also way more speeders than drunk drivers each day, so this is somewhat invalid.

    the best drivers tho are the drunk speeders

  26. shocked at how much of a pussy afink is, i also dont drink and drive, but yes i go 10-15mph over the speed limit on the highway ohhhhhhh im so bad. fight the man, fuck paying speeding tickets. do anything in your power to get it reduced/nollied

    also lol at taking a day off work for a speeding ticket. when u are the boss there is no need to take a day off from work.
  27. Conveniently I prescheduled two weeks of vacation starting today through may 8th. the court date is may 4th so hardly an inconvenience to go out there and fight it on a day I already had off. The only weird thing is the court time is 7pm, never seen that before in my life. Just means I'll probably head out to Charles Town earlier in the day to play some poker until its court time. Hopefully I can win some money at the table to cover any fines, or I'll run so bad at the tables so that I'll due for a complete break at the courtroom. Win-Win!

    A lot of helpful advice here though, definitely appreciated. West Virginia says its 5 points for doing 15+ so by admitting guilt on the back of the ticket I don't see any fuckin way this doesn't affect my insurance in an extremely negative way. Zeppelin has a good point about him writing a lower number if he felt so inclined. Since the court date is at 7pm should I try to talk to the prosecutor first thing in the morning or just show up a couple of hours early at 5-6pm? The 7pm court date definitely seems odd. Not sure if it makes it more likely for the officer to show up or less likely. I got the ticket at 830pm fwiw so perhaps the officer usually works that time and can just zoom over to the courthouse to testify for a quick minute or two?

    That's NY tho. No idea how any other states/cities works. My initial thought was well I'm obv guilty, nothing to hide, don't want to lie to anyone, so I should just man up and take the points and insurance in the ass, but everyone I talked to told me to plead not guilty because "that's just how the system works," as fucked up as it sounds.

    Bottom line is you don't want moving violations on your record. Insurance goes up and if you get a few of them in a short enough time span then it's gg driving license. I've had 2 incidents reduced to non-moving violations (speeding ticket and an "overtake school bus" ticket that I won't even get started on). If I would have manned up Afink style then I'd be sitting on 9 points, higher insurance, and 1 more moving violation away from suspended license. Instead, I have 0 points, nothing reported to insurance company, and only charged with 2 parking tickets and out some money. Yeah, I felt like an asshole, like I was getting away with something because I was obv speeding, but that really is how the system works.

    Details of getting my speeding ticket reduced was I marked the ticket "not guilty," mailed it in, got my court date, showed up, a ton of other donks were sitting there for the same thing, some dude (district attorney or someone, not sure) was calling off names and handling everyone's case. He never even asked me why I plead not guilty. Hell, he never even made eye contact. All he did was ask if I was willing to accept a lesser charge of a parking ticket and pay a fine. Insta accept. He filled out some paperwork, sent me to another room in front of a judge, I said "guilty" to the reduced charge of the parking ticket, paid my fine, and that was it.

    Cliffs: Never plead guilty to a speeding ticket.

    edit: LOL, found my post from 2.5 years ago about the school bus ticket, which ironically Afink replied to saying I'm fucked and should pay the fine. I was facing a possible $250 fine and 5 points, but instead pleaded not guilty (cop even told me to plead not guilty) and got it reduced to a parking ticket of $150 fine and 0 points. Judge lectured me about how serious of an offense school bus tickets are and told me I was getting off super light. Lucky me.
