We had to change our minds for the same reason when we were looking for our dog. We wanted a beagle, but they were a little too big.
We got a 'puggle' which is half beagle/half pug and are the cutest/smartest dogs in the world. Would recommend one to anyome and is perfect size. -
The apartment I was moving into when I got my dog had the same policy...I have a Walker Coonhound and he was a puppy at the time and looks like a beagle.
They get to between 50-70 lbs (mine is 65) but they are lean so they look like they weight less. I just told them up front that he would weight under 35 and they were fine with it being a little more. If they aren't on site they don't really see them. When he did get bigger I just told them that he was a mutt and the place told me he was supposed to be smaller. The other dog I have I got as a puppy and was supposed the same a coonhound mix and as you can see hasn't grow up the same.

get a short haired/short legged one, they are awesome -
You really should check with the complex about the rules. If neighbors complain about your dog and it does in fact violate the terms on the lease; either the dog goes or you and the dog goes, while you will be still responsible for rent.

Dude...all dogs under 25lbs suck (flame on)...buy the dog you want, as a puppy I assume. Then, it's well under 25lbs...it's not your fault if it goes through a growth spurt...don't let some assholes that you PAY money to control your decisions...

Well, I've only had one dog so far in my life, and it was a basenji. Obv to my biased ass it is the greatest dog ever, but from an unbiased perspective I would not recommend that you get one of those if you live in an apartment. Basenjis need a nice back yard to run around and play in, cuz they are like the 3rd or 4th fastest dog breed in existance, so they need some room to stretch their legs. They are also pretty difficult to train compared to most breeds, and extremely weird. I love them, but that's just me.
If I get another dog, I am most likely going to get a Shiba Inu.
Both the Shiba Inu and the Basenji are usually 20-25 lbs btw

whatever you do, don't get a boston terrier. my cousin has one and i absolutely hate that little fucker.
