In 2010,Michael Nash, 61-years-old, was at the Lexington VA Medical Center, undergoing surgery for a penile implant replacement and circumcision. The surgery was successful but problems arose during the post-operative care, his lawyer said. The lawsuit claims that the nurse placed ice packs on Nash’s penile area to reduce swelling, but left the ice packs there for 19 hours. “The result here is tragic,” Nash’s attorney, Larry Jones, said. The lawsuit alleges that there was severe frostbite on Nash’s penis, which led to gangrene of his glans penis. “Because of the frostbite and the gangrene on his penis, he had to have a very significant portion of his penis amputated,” his attorney said.

Of course this happens in my hometown.
My grandfather had a triple bypass surgery this same VA hospital. They left a rag in his chest cavity and he almost died from infection.
I tried to convince him to sue then but veterans are extremely hesitant to mess with the VA...apparently unless it deals with their penis getting amputated. -
Article states the "ice pack" was left for 19 hours not that it stayed cold for 19 hours.

Better discount his damages, if any, by the fact that he apparently already had a defective unit.

How long would it take for frostbite to affect a schlong? With how sensitive and unexposed to the elements that skin is to start with, I'd imagine it wouldn't take long for frostbite.

At no point over the 19 hour period he didnt think to ask to have it removed, or remove it himself, or if they were changing say, "Yeah my dicks cold enough, no need for another"?

why was the fed suit denied?
The department of VA Affairs said that “it is our opinion that there was no negligence.”

I would guess the article meant to say that his Federal Tort Act Claim was denied at the agency level. Once the agency denies the claim, the claimant can then file his claim in federal district court. This kind of how it is when one tries to sue the government or under a federal law. And when the government professes to make the procedures streamlined like for people denied Social Security disability or people denied health/disability insurance benefits/coverage under an ERISA plan. They streamline people right out of their due process rights, like the right to call witnesses on their behalf. BY the time they realized they got fucked and hire a lawyer, its a done deal. You might be amazed at how the deck is stacked against an individual suing their own insurance company for denial of benefits under an ERISA plan. ERISA stands for Employee Retirement Income Security Act. It's a great name for a law that fucks the employee. One of the reasons I am against government run healthcare. The government is not about to let individuals dictate to them through the court decisions and rogue judges what their coverage is or should be. Not a chance in hell.

If you came out of that surgery you might assume the numbness was standard. Possible that if you were in and out of consciousness that you were never even aware of the ice if it numbed your nuts while you were out. -
Very true, still seems like a rather long time to not realize something was going wrong. Obv most of blame is on the hospital staff for being morons, it just seems odd for it to have been 19 hours.
