i know we are supposed to record our winnings on our income tax, but if we are in a state like texas where gambling is illegal, would we be prosecuted?

no, because we don't pay state income tax...just federal
but tax evasion is +EV, I condone it
gambling is not illegal in texas, there are indian casinos here, and as long as the house isn't taking rake, there are some live games here too -
The IRS' official stance is they don't care how you made your money, you are supposed to report it.
