  1. Two people will be implicated here, you can probably guess who. One is going to be removed from online poker forever and one is going be removed for a fair amount of time.

    I was asked not to post specifics and that AP's statement is going to be detailed and is going to be released Sunday morning.

    And it does not resolve the problem of how a rogue employee/owner exec or whatever could pull off something like this.

    There were apparently insufficient internal controls at AP to prevent this sort of thing or it is more than two people involved.

    In NCAA terms there was a "lack of institutional control".

    The bigger picture, especially for US legislators, is whether the security, regulation and control is adequate. If this is not resolved, less restrictive regulation in the US is a pipe dream.

    If KGC can take control and enforce its regulations then it can show the world that there is some form of regulation and enforcement.
  8. I am really glad that nat, adanthar and others kept pursuing this huge problem that was obviously going on at AP. Nice job not stopping with there constant lies saying that no cheating ever took place. Very nice work everyone and Im glad to see they finally admitted to the huge problem that was going on with their company and I really reallly can't wait to see what there statement says tomorrow.

    Kind of a Marbury v. Madison of online poker.

  10. I am sorry, but "banning" somebody forever is lame. Anyone who wants to can open up an account under another name. Why don't they just send him to stand in the corner? They should pull all his hand histories and make him give the money he stole back to its rightful owners. This is the only outcome that could make this right.

  15. So how does banning two people fix the problem that their security could not detect the most obvious type of cheating, or that chip dumping went on for days?

    Banning two people fixes the fact that the company lied?

    I still don't see how banning two individuals makes your money safe on this site, unless those two people were the entire security team.
  16. In regards to the 1k. I hope they dont do it like when a multiaccounter gets caught, and they just bump everyone up a spot. If they wanna bump up everyone a spot, i dont care, but i just want my buyin back, and all others who didnt cash should get their buyin back (except the multiaccounters, burn them).

    Also, wasnt the previous 1k won by an account that was ghosted by the superaccount? And several other tourneys were won under shady circumstances? I hope they go through all tourneys and cash games that were affected, not just the 1k that potripper won.

  17. The regs provide for certain "Control Systems". It would be interesting to know if AP's "Control Systems" complied with the regs or not.

    Addititional, I could be wrong, but I think the individual offenders cannot be banned unless they are employees or agent who are licensed or operating under the companies license.

    This should address the issue of the alleged offenders relationship with AP.

    If they are banned they would be entitled to a hearing as well unless they agree to their suspension/revocation. That could be interesting, but my guess is that they would go quietly.
  18. My head is starting to hurt after reading "two implications" ... this is not going to be good.

    Nat you rock, as do all the folks who have been keeping this moving in the right direction, but I fear this is not going to be worth the energy one burns to keep the screen glowing.

    Mens rea is the difference between murder and manslaughter.

    Look forward to seeing the "statement" tomorrow, and based on last series of them, it will no doubt be filled with sunshine and daffodils.

  22. I'm certain that the crimes were not commited on the reservation. Does'nt the IP address trace back to Costa Rica. I'm certain they have harsh penalties for theft.

  24. My point is that there are interesting jurisdictional questions.

    Such as does the theft occur in the jurisdiction of the thief or the victim or maybe both?

    My other point is that we are in somewhat uncharted waters as far as enforcement of penalties for illegal conduct in this matter.

We, the Players, Hereby Request and Demand that EVERY Poker Site Provide the following Protection and Security, for ALL Players, be they Professional or Amateur, High or Low Stakes, Limit or No-limit, Winning or Losing, Aggro or Timid, and for all time, starting as Soon as is Humanly Possible, reserving all Rights not Specifically Granted to that Site, to the Collective Will of all said Players, and existing for the Sole Purpose of Serving those Players:

    1. All "superuser accounts" shall be listed with the Gaming Commission (KGC), and regulated by KGC that they are inactive or perpetually monitored.

    2. All accounts which are inactive for any period automatically monitored for any irregular activity, and suspended after a reasonable amount of time.

    3. Computerized systems must monitor for "statistically implausible" results by any one player during any two tournaments or any significant time in a cash game. This shall include streaks of losing (chip-dumping) as well as winning.

    4. All sites must automatically and unerringly forbid multi-users from any one IP address or consecutive or one-gap IP addresses until the user can assure the absence of collusion.

    The Foregoing are Initial, Immediate demands and are Unnegotiable. These will be followed by Further, more Stringent Requirements.

    If they are Americans, then perhaps they can be nabbed on wire fraud charges.
