Could we file an injunction against the govt because this law aims to prevent some of us from working and providing for ourselves and our families?
I am in a VERY difficult spot here. I am not a rich poker player. I grind out SnGs and NL cash games to bring in $30 an hour... BUT THIS IS WHAT I DO. I have no other job, and I haven't been in college for a year and a half (no degree). I love this game and had all intention of playing it for the rest of my life. However, I do not have a ton of money saved up to survive on, so this is like getting fired with no severance package. I have debt from student loans, car payment, insurance, rent, etc. just like everyone else. If online poker is made illegal, I can't go play in a casino because I live in TX and we don't have them. Additionally, I have an apartment lease for the next 11 months, so if i move to Vegas I still have rent to pay here. I know there are more of you out there in situations similar to my own.
My question here is, doesn't the Constitution protect my right to make a living, as long as I am doing it legally? If the act of playing online poker is not illegal, but funding online gaming sites with money from American banks is... my JOB is still legal, right? Doesn't this mean that we potentially have a case that can go the the Supreme Court? I have a legal job that I am being prevented from doing, and I don't have anything to fall back on here. Adam, Cal, Lenny, Dan, and some of you other people are in this same boat too. Can anyone with a law degree or in law school tell me if this is even feasible? How do I go about this if it is something achievable? Can we band together with some legal action, P5s v. Frist?? -
this has already been brought up and now your arguement is the same as drug dealing. There is no legal action that can be taken. Im sorry how this has affected you but I think its time to go out and find other means of money as a safety net

What makes this the same as drug dealing? I was under the impression that playing online poker is not to be made illegal...

The simple fact is that according to the government, the 1961 wire act would say that online poker is illegal.
Now the government has never taken a strong position on this as this would be tough to sustain in court, however any such injunction that you are seeking through the courts would first have decide what that 1961 law really means today. -
playing online poker has always been illegal....just never really did anything about it
