OK, so I was gonna sign up to go to a private tourney and I figured I'd check with our provincial gambling authority, the AGCO, about whether these types of tournies are legal or not. They told me they don't regulate them so they are likely illegal but to contact a lawyer.
I didn't contact a lawyer (I don't know any and I'm not retaining one for this!) but I did a little research and it looks as though poker is a crime in canada: in other words, it contravenes the Criminal Code.
Is there anyone out there who knows for sure whether this is true or not? -
I used to host games a lot so I read up on the "legalities" of home tourneys, and yes, as long as the stakes are innocent and there is no tourney fee/rake taken, it's fine.
I've played in quite a few home games that did charge rake/fees, and I've never heard of any of these people getting raided. There is a semi-well known local 2/5nl game in my home town that takes rake, and they have been raided a few times, but that's over the yearrrrrs with people playing there every day. The cops haven't done much at all to try to stop the game, so I assume they just see it as small potatoes. My buddy was there once when the cops raided the place and nothing happened to him. (except for losing the money he had in the game) Even the hosts didn't seem to face many repercussions. -
I use to play regularly in one til it got busted. If the house is making a profit then it is not legal to run the game. It was written up in the Toronto newspapers. I think I posted the story link here when it happened (year+ ago)
