  1. Just a heads up to everyone who plays on PS and uses Bank of America. I used the e-check system to deposit to and from my account and Bank of America froze my account and then closed it because they said I was receiving funds from a gaming company illegally. Which was true! Big mess that has taken forever to clear up.
  2. So what happened in the end? Is online poker illegal in KS?
  3. What gaming company were you illegally receiving funds from? Has anyone called the cops?
  4. No law against online poker in Kansas. I was told it was a federal law against banks handling gaming transactions from foreign companies.

  7. I use e-check with B of A, too, but nothing has happened. My transactions have been pretty small, though, all of them less than $500. Were yours larger?

  9. Oh, okay. I must have misunderstood. I thought they had seized your funds and caused a big problem with your account. My mistake.

    PS: the regulations regarding the handling of online gambling funds and financial transactions have not been written or approved yet. "The second biggest bank in the U.S." has taken this all upon themselves, the actual law or rules have not be finalized.

  11. Only semi-true Ted. While a lot of the so called rules aren't set in stone and the Commerce department has said this may be "unenforcable" a lot of US banks have corporate policies not allowing these transactions and they will indeed shut your account down if they know that's what you are using the transactions for.

  14. My girlfriend is a VP for bank of america in NC {brag} I called her after reading this post. She said that Bank of America is trying to crack down on gaming sites? I guess the banks are getting togther to stop any online trans? I use epassporte with no prob but i have not put money in for a while. I will try tonight. I think its bullshit IMO
  15. I have an account at 1st convenience and I'm wondering if it'd be safe to assume that since my bank allows me to deposit to pokerstars via eCheck that it would let me receive funds the same way? If I ask, would my bank tell me if any other accounts had been closed due to this.
  16. If you tell your bank that those echecks went to a gaming site your account will be closed in 2 seconds. Believe me!

  17. I think this is true in general. I'm also a kansas resident. Tried withdrawing 2k from FTP a couple weeks ago through bank transfer. It was declined by my bank. I called and they said they aren't accepting transfers from gaming companies. Had to take a check :(

  19. you are splitting hairs just to be argumentative, ted.

    it is illegal. the UIGEA says so. it may not be enforced by the feds currently, but it still is illegal. the bank is obeying the law on their own by making this policy.

It's not that banks are "ganging up" to stop taking this transfers it's more that they are anticipating federal regulations coming in and gearing their policies to that as opposed to facing massive fines. There have been a number of legislative moves related to bank transactions, not just having to do with online gaming, that put the responsiblities on banks to monitor their transactions a lot closer. (See Spitzer, Elliot)

    A good question was brought up on the other post in regards to banking on what top online players use. I would think the that checks via a third party is where you are eventually going unless legislation is changed. Some people use the debit cards but you are going to be limited to a certain amount of cash each day with those.

Banks adhere to state and local laws...a federal banking system is illegal..BOA though in many states id chartered to do business in each state...aside from the federal insurance up to 100K and reporting over 10K transactions that is a decision made by your branch manager based upon state intepretation of the uigea (sp) law...GL2U....

    I've used e-checks ever since they became available and never had a problem (I use B of A too). I have one that I did yesterday and I'm trying to have stars cancel it now.

    This may be a stupid question, but if I just request a normal check from stars will that still work?

  25. What is illegal? The government has not defined the terms yet. What if in the future they decide that buying toothpaste falls under the definition of "gaming transaction"? If I charge some toothpaste on my VISA card today, is the bank breaking the law because they did not block it?

    What if they decide tomorrow that online poker isn't gambling, only online slots? Is the bank obeying the law by blocking poker transactions today?

    The law has not been defined, It is not enforced by the feds, and the government admits it is flawed and unenforceable. The bank is making it's own policy, not obeying a law.

    Theoretically, A bank could decide it will have nothing to do with any transactions that deal with companies that begin with the letter "W". They could shut customer accounts down whenever they attempt a transaction with Wal-Mart, or any other "W" company. They could tell these customers that they are obeying some mysterious federal law.

    In that case, they would not be obeying a law, it would be their own stupid policy. Just the same as it is with these e-check transactions.

    Actually, this STATE OF CONFUSION was predicted when the poorly written law was passed and the long (almost 2 year delay) in coming up with actual regulations. Soon Banks may stop legitimate gaming transactions (remember the exemption for horse racing?) What if Harrahs casino or the Bellagio gives me a check and some bank denies it thinking it is obeying some undefined law?

    Let's hope they don't start "anticipating" laws against accepting direct deposit of my paycheck. What an amusing concept. Guilty for failure of anticipation. So you think the feds will retroactively fine banks for not complying with rules that have not been written yet? LOL

    I've deposited normal checks from poker sites at BoA a few times over the last few months and had no problems at all. Epassporte has also worked fine.
  28. I used epass a while ago but the max I could take out was $300 a day and you get charged everytime. The $300/day is a huge pain the ass, and their support is non-existent
     
  29. i just got a fairly decent sized amount wire transfered to my BoA account from pokerstars and it went through fine.
