  1. I read the article today about them trying to say it's illegal to play online poker in Mass. Are there any states that already have this law in place or is this the first state to do this?
  2. As of 2006 Online Gaming (wagering) is illegal in all 50 states. People interpret this LAW differently, the same as head shops in Cali interpret federal laws against marijuana, until they get raided. Read the act yourself... Google "2006 Safe Port Act" and then scroll to page 212. The verbiage is pretty clear.

    On the other hand... this quote sums it up pretty well:

    <span>Traditionally, gambling statues have been enforced in the US on the state level. Some individual states do have laws on the books that can be interpreted as prohibiting Internet-based gambling. Once again, it should be pointed out that as of the writing of this no person has ever even been charged, much less brought to trial or sentenced for playing poker online. Millions and millions of US citizens play poker and gamble online each and every day. And not a single one of them has ever been charged, fined, or prosecuted.</span>

    <span> Based on the above, the odds are overwhelmingly in your favor that you can safely play many, many hands of online poker without any legal repercussions whatsoever.</span>
  3. The 2006 safe port act made it illegal for banks and financial institutions to transfer money to sites that take part in illegal gambling. No where in that law did it attempt to define what illegal gambling is, it assumed that there are at least some forms of illegal online gambling based upon past laws, such as The Wire Act. Please get your facts straight sir.

  5. I'm familiar with that, but have any states on their own come out and said that it's illegal in their state like Mass is trying to do?

  7. Easy buddy, I'm on your side. I play online poker nearly everyday. The only exceptions made by the government for this law are fantasy sports, horse racing and state lotteries.

    We can attempt to spin the part about banks and financial institutions, but the verbiage of the following line is not really debatable:

    <span>Attached to the Safe Port Act was a provision known as the </span>Unlawful Internet Gambling Enforcement Act (UIGEA). According to the UIGEA, "unlawful internet gambling" means to place, receive, or otherwise knowingly transmit a bet or wager by means of the internet where such bet is unlawful under any law in the State in which the bet is initiated, received, or otherwise made.
  8. This was a looong time ago, but Washington state made online gambling a Class C Felony.

  11. There is no federal law that makes playing poker online illegal. Despite what bdudz says above the UIGEA doesn't make any form of playing poker illegal, just making certain types of bank transfers. The link below goes over every state and links to any specific states gambling laws.

  24. there are 11 states where it is illegal to play online.There is a list on this site somewhere.The stuff going on here in mass is what is going to happen to the whole country if we let democrats run everything.Although all politicians are self serving pos's in my opinion.
  25. It's not Democrats or Republicans specifically against it. It is conservatives, catholic zealots, who want to make online gambling and gambling altogether illegal. Conservatives usually are Republicans, but not always.

    What's happening in Mass. I think is more of a greedy governor. He wants all the gambling in his casinos so he gets his money.

  28. Whoa, there buddy. Yes most conservatives are republicans, but don't lump all conservatives in with the Religeous Right. Most conservatives don't want to infringe upon any individuals rights. Those that do are usually closer to the fringe of the party, like socialists are the fringe in the liberal (democrat) party.

    Legality of online poker has nothing to do with Party Politics. For the extreme example, I live in Liberal, Democrat controlled Washington State where our Liberal, Democrat Governor signed the law that makes it a Felony to play a game that is legal everywhere except from the comfort of your own chair, in front of a computer screen.

    Special Interest Groups for both parties hold the cards here, not Party Politics. Republicans, Democrats, and even Jesus lovers like poker. Casino Owners (Tribal or otherwise) like poker when it's played at their casino.
