    The groups that pushed for UIGEA are, in the wake of the DoJ announcement on their interpretation of the scope of the Wire Act, seeking a federal ban on online poker and other online gaming!! Their letter to Congress is HERE. We'd better all be sure to speak up here and do our part to ensure that our reps on Capitol Hill hear from us, and we'd better do it now. If YOU don't participate, you are allowing these groups to claim that they speak for you. Don't let them speak for you. Let's all be sure to let Congress know that we demand our right to play and, by doing so, ensure that they know that there's no chance of any legislation passing that does not include licensing of online poker.   6. Rich, the last couple times you gave a Facebook suggestion for Senator Reid, it didn't work for me. If that happened to anyone else, the one that works for me is this.

    The groups that pushed for UIGEA are, in the wake of the DoJ announcement on their interpretation of the scope of the Wire Act, seeking a federal ban on online poker and other online gaming!! Their letter to Congress is HERE.

    We'd better all be sure to speak up here to ensure that they hear from us. Our goal is not to prove them wrong via debate. That never works in general and surely won't here. Rather, we wish to show them that the prudent course would be for them to give up on poker, as any bill that sought to ban poker would be doomed to defeat.

    Today's action:

  18. I wrote to one of my congressman's staffers:

    Hi *****,

    I hope all is well. I wanted to apprise the congressman’s office of a letter some anti-gaming groups just sent to Speaker Boehner, which you’ll find attached. While no one honestly thinks Congress will pass legislation banning all online gaming – especially in the short time window that is available (prior to states authorizing intrastate gaming) – it is disturbing in the larger context. These are groups that purport to speak for conservatism, yet they are actively advocating bigger government, executive branch expansion, and reduced states' rights.

    When these groups complain that the executive branch will no longer read a broad ban on online gaming into the Wire Act, rather than the ban on interstate online wagering on sporting events or contests that is defined in the actual text of the legislation, that is of great concern to me as a REINS-endorsing limited government conservative. The Constitution defines a process by which the legislative branch writes the laws, the judicial branch interprets them, and the executive branch enforces them. When groups like these insist that the executive branch perform all three functions unilaterally, they weaken the case for Constitutional government and separation of powers as a matter of principle, while also weakening the principle-based case for REINS (my principle-based case for REINS: http://www.geoffdavis.house.gov/News...umentID=205179).

    In addition, the aims of the letter are harmful to the Commonwealth, as their request would apply to interstate horse race wagering conducted under the auspices of the Interstate Horse Racing Act. Horse racing interests have had enough problems due to prior executive branch overreach on the scope of the Wire Act of the sort these groups champion. It is sad that they advocate compounding this.

    Regarding the state-level bills that concern the groups so much, I agree that we don't need a patchwork of state laws with the federal government left holding the enforcement bag, nor should we have states erecting trade barriers against other states. Our founders included the commerce clause in the Constitution for very good reasons and we ought not violate that important principle here. After all, just as our nation would never permit Indiana (for example) to bar automobiles manufactured in Kentucky on the grounds that Indiana could socialize auto manufacturing for the financial benefit of the state, surely we ought not have state lotteries or other instate interests granted federally-enforced exclusive monopolies over online gaming. Additionally, online instant scratch-off lottery tickets -- the functional equivalent of an online slot machine -- would surely compete directly with private businesses in many states.

    There is a better way forward. HR 2366, Rep. Barton’s Internet Gambling Prohibition, Poker Consumer Protection, and Strengthening UIGEA Act, actually gives these anti-gaming groups what they want, but in a way that respects our principles and our Constitution. Rather than upending states’ rights and limited government principles, we can instead license and regulate interstate horse racing and games of skill like poker in a manner consistent with the commerce clause and limited government principles, while preserving states’ rights with a state ‘opt-out’ provision. I had a great discussion with Grover Norquist on this prior to the 2010 election that you may find of interest (read at http://poker.blogtownhall.com/2010/0...ne_poker.thtml).

    For the Commonwealth, conservatism, consumer protection, law enforcement, and liberty, I ask that Rep. Davis cosponsor HR 2366. I think it’s the right bill at the right time and I hope the congressman will give this due consideration.

  20. After reading the letter these numbskulls wrote Boehner, my blood pressure just went up dangerously high. Not only are they hypocrites and scoundrels, they also are completely misinformed on some of the points they made. Two glaring examples were :

    A. They opened the letter by saying that "Six years ago, congress voted overwhelmingly to protect vulnerable communities within our country as well as the integrity of professional sports by stopping the expansion of gambling on the internet". Really? The truth is, the UIGEA was snuck on to a Port Security Bill, which was passed overwhelmingly. Most congressman DIDNT EVEN KNOW A GAMBLING PROVISION WAS IN THE BILL. So if congress was SO interested in passing an anti-internet gambling act., why wasn't it able to pass a stand alone bill even though it tried for the previous 5 years? The fact that it was stuck onto a must pass port security bill ON THE LAST DAY OF LEGISLATIVE SESSION is hardly a congressional crusade against online gambling. Fact is, it was Martin Gold of the NFL who had Bill Frist tack it on, and it's laughable that fantasy football and horse racing is exempted in the bill. So I guess these moral soldiers of God don't mind their flock spending the holy day (Sunday) watching football for 6 hours, and spending "family time" time picking out their fantasy football players, and I guess betting on horse races is fine with them to since they dont seem to object to that exemption in the bill. Pretty hilarious that they parrot the NFL's "integrity of the game" stance in their first paragraph, even though that has NOTHING to do with anti-gambling or protecting the family.

    B. They made it seem like Eric Holders DOJ's sudden statement last fall that the wire act pertained only to sports was some new revelation that changed precedent. The fact is though, a federal appeals court made this ruling all the way back TEN YEARS EARLIER. It's also ironic, since Holder is a former NFL representative who made Black Friday happen in the first place. His statement was clearly to help his State education union workers and lotteries (who are big Democratic donors)get more pie.

    I'm curious about a few things. If they see online gambling as the ruin of the family, what does that say about the strength of character of their "flock". I mean, isn't morality doing the right thing in the face of temptation? Isn't it better for your children to CHOOSE to be moral than to be FORCED to be moral? If they are so worried that the "family" can get ruined from a machine that has games on it, than they better start living in communes and building fences because their is a heck of a lot more for them to worry about that some online card games.

    Also, what about those of us who are adults without families who choose not to have them? Should we be put into Carousel once we turn 35 and have no wife or kids? (NOTE : Obscure Logan's Run reference).

    The biggest joke of all is signers like Hanna are from the Let Freedom Ring group, and William Murray is from the Religeous Freedom Coalition. So, they want freedom to practice their lives according to their beliefs, but the rest of us should be denied our freedoms by legislative force?

    I thought it would be interesting to look into the people and organizations who signed this letter. Now, I already knew about Gary Bauer and Bill Donohue. Baur is a clueless dunce with the personality of stale bread, but if online poker companies sent 10% of their gross to Israel, he'd change his stance, believe me. And Donahue is just a despicable loudmouth who has defended the abuse of children (yes, he really has in a weird way). I'm sure his catholic churches that have casino nights to raise money for the church are just fine and dandy to him. But I wasn't familiar with Colin Hanna and his Let Freedom Ring organization, so I thought I'd check it out and I was completely floored by what they "stand" for.

    You'll get a kick out of this. Colin Hanna and Let Freedom Ring, a signer of this letter to Boehner, advocating the government intervention to prevent online poker, gambling, and defender of a law that banks did not want because it imposes more government rules regarding money transfers has this on his website :

    "Our mission is to promote" -

    Limited Federal Government
    Free Enterprise and Economic oppurtunity
    Economic Freedom
    Profit as an economic incentive
    Original intent of the constitution
    Constitutional Government

    So if your'e all as confused as I am, as to why someone whose main mission is Limited Government, Economic Freedom and Profit as an economic incentive would sign a bill asking for MORE federal government and LESS economic freedom, be sure to visit his website and contact him like I plan to do at
