I was reading a copy of the New Jersey State Constitution and this is how they define gambling:
<blockquote>
b. "<span>Gambling</span>" means staking or risking something of value upon the outcome of a contest of chance or a future contingent event not under the actor's control or influence, upon an agreement or understanding that he will receive something of value in the event of a certain outcome.
</blockquote>
Does anyone else see how this does not define poker? -
In poker you have a skill element where you can influence certain aspects of the hand.
