Stars Suspended My Acct: EDIT- FML W/ STARS RESPONSE & RESOLVE THAT RAPES ME
By BigDShaggyJ on 07-21-2008 11:02 PM

new Edit below the --------

Hello Danny,

I am contacting to inform you that your account has been suspended. It
has
come to our attention that you recently received a number of transfers
from the player unrivledmstr with whom we have an outstanding matter.

For our records what is your relation to this player? why was the money
transferred to you?

We have also noted that recently you have shared computers with the
following players Minamoto74 and x7me7a if you could elaborate and your
relation with these players.

We look forward to hearing from you.

Kind Regards,

Henry.

unrivledmstr was my roommate in Vegas for June and half of July during the WSOP. the xfers between our accounts were to cover rent expenses, & sidebets.

as for the other 2 accounts Minamoto74 and x7me7a I have never heard of them nor associated with them and have NO IDEA how they said we have shared computers. I had never logged onto stars from any cpu other than my laptop the entire time. however there were 6 people living at the house during the 1.5 months sharing the same internet connection via a router.

I emailed stars replying to this 15 hours ago and have yet to get a response. wtf can I do besides wait? how long do they usually suspend accounts for in times like these? terrible timing too, sfrigged i won the $55 25k yesterday like an hour b4 my account got suspended and have yet to withdraw the money.

-----------------------------------------------------------------------

I wake up this morning to find an email from pokerstars that just fucks me completely.

You should tell the guy he owes you all of the money - its his transfers that have been negated.  If someone writes you a check - and the bank says the check's account was closed because of fraud...they still owe you the money.  Let him chase the people he was associated with to get the $$ back from them.

That really sucks bro, I am sorry to hear how you are getting the shaft on this. Did they take the money straight from your account since you just had that 13K score, or do they expect you to pay them from an outside source. Either way I hope you get this back.

I think that PS has treated this very professionally and correctly.  Apparently, your scum roomate fraudulently got the money (maybe multiple accounts etc.) and then used some lame excuse to have the money transferred to your account in exchange for you giving him the cash.  PS now deducts the amount from your account and provides you with a full explanation.....in other words, it is your problem in trying to get the money back from the scumbag...not theirs

Go to the scumbag and have him pay you for the money you "lent" to him....plus interest and expenses for going through this mess.

BTW....what was the $150 that was credited back to you?

It's the same as buying a painting and then it is discovered that the painting was a stolen one.  Under the law, you would have the painting taken back and returned to its rightful owners, and you would be out the purchase price of the painting.

Based on the information provided, Poker Stars has done the right thing.  They traced ill gotten gains from a scumbag who happened to transfer some of his loot to an innocent third party, the OP.  I say innocent, although, the responsibility with becoming associated with scumbag lies with OP and the responsibility for transfering funds to settle outside debts lies with the OP, so he is not a completely innocent party, although both he and the original victim are certainly victims of the scumbag thief.

The only fair thing is to return the stolen property to the rightful owner.  Poker Stars has simply followed long standing common law that an innocent purchaser of stolen property, the OP, can acquire no rights in that property because the seller had no rights in the property to transfer. Nemo dat quod non habet.

It should be pointed out, however, that some countries like Switzerland have enacted law peculiar to art theft that allow an innocent and bona fide purchaser of stolen art work to keep it.

Very interesting.....I guess the key is that it has to be a bona fide purchaser.  Buying for less than market value would negate any presumption of "bona fide."....right?

It certainly could because it would put you on notice that something is amiss.  For instance purchasing a car stereo from a guy out of the trunk of his car for 1/2 price might indicate there's a problem.

Sorry to hear. Sounds like the guy unrivledmstr is a douchebag and f'ed you over. It sucks trusting people and getting screwed for it. I think Stars definately investigated it fully though.

Nice with though.

I don't like the resolution.  Here's my opinion.  I may be wrong.

For argument's sake:

Say Jim robs a bank.  Jim gets $5000.  Jim goes to the grocery store and spends $300.  Are the police going to go to the grocery store to retreive the funds for the bank?  No.

If there was illicit activity, it is pokerstars responsibility, before they allow the transfer, to do a security check before they allow the funds to move.  Once that money is transferred to you, it's yours.  Pokerstars does not reserve the right to just take it from you.

Pokerstars should try their best to get the $$ back from unrivledmstr.  There is nothing in their terms of service that allows for money that is yours to be taken from you.

What I would do if I were Pokerstars:

- Return your funds to you
- Put something in the Terms of Service that states that if you receive funds from another player, they may be confiscated if that player was found to be cheating and the funds cannot be recovered from that player.

I don't like the resolution either, but if they don't confiscate the OP's money, people could then obtain funds on Stars through fraudulent means (bounced e-checks or even making money in a cash game through collusion ), transfer the money to another account in exchange for cash and disappear. The two accounts could even collude to "launder" the money, but Stars couldn't do anything about it because the funds now belong to a different person.

I'm not saying the OP was colluding with the guy who transferred him the money here, I'm sure he wasn't. But if Stars lets him keep his money, this would create a huge loophole that people could take advantage of.

we never exchanged PS $$ for cash, it was simply to pay for his rent at 2 houses we rented via las vegas retreats as well as sidebets that we had during the summer, IE last longers etc. the $150 i sent to his acct was the result of a last longer.
what confuses me is the timing. prior to my win in the $55 25k on sunday I had roughly 1kish on my stars account. my account was frozen about an hour after the win when I had nearly 15k in my account. did they choose this time to take action because I had the funds in my account to cover the losses? what would they have done had I not had the funds in my account to take back? would they have just put my stars acct balance at -$3650? ftr I've tried contacting unrivledmst numerous times since recieving the email and no luck. i doubt I will see a penny of this money. I just essentially freerolled his entire summer unknowingly. LIFE TILT!!!
