Dear AP Player:
I am the former Grand Chief of the Mohawk Territory of Kahnawake and the owner of Tokwiro Enterprises ENRG, which holds a 100% interest in Absolute Poker.
As many of our players are aware, there has been a security breach in our system that allowed unlawful access to player information that resulted in unfair play. I am writing to you today to let you know what we know so far in order to set the record straight, and to assure you of AP’s commitment to player security. I am sure that this letter will not address all of the questions and concerns you may have, nor will it extinguish the heated discussion surrounding this issue. At this point, our intention is to let you know all we can disclose and to assure you of our continued efforts to keep you informed as best we can as the investigations continue.
We deeply regret this situation has occurred. A breach in security in online poker is serious and of great concern to players and the industry worldwide, and this particular situation has been the subject of debate within the poker player community and in the media, giving rise to the creation of several websites and hundreds and hundreds of comments, opinions, and theories of what occurred – some of which are accurate, and some that are not.
Like you, I have not been happy that during the initial stage of our investigation, AP has not been more forthcoming in providing a timely or comprehensive explanation on this matter, giving rise to anger, suspicion, and concern on the part of our valued customers. I hope that our customers can appreciate that this remains an incredibly complex and sensitive issue, and I want to give you my strongest possible assurance that we will be as forthcoming as possible on how this breach occurred and what we are doing to remedy the situation.
What We Know and Actions We Have Taken
AP was notified by a customer that a possible cheating incident occurred during a recent tournament, and in response forwarded players’ hand logs. This disclosure of the hand logs prompted our customers to determine that a more serious security breach had occurred. We immediately launched an internal investigation and also requested a formal audit by Gaming Associates, an acknowledged world-wide expert in audits, interactive gaming tests, and information security.
Based upon our preliminary findings, it appears that the integrity of our poker system was compromised by a high-ranking trusted consultant employed by AP whose position gave him extraordinary access to certain security systems. As has been speculated in several online forums, this consultant devised a sophisticated scheme to manipulate internal systems to access third-party computers and accounts to view hole cards of other customers during play without their knowledge. As this consultant was aware of the details of our fraud detection process, the likelihood that the scheme would be uncovered through our normal procedures was minimized. We consider this security breach to be a horrendous and inexcusable offense.
We will pay for all losses suffered by the affected players as soon as our audit is finished and the amounts are determined. Although we are in the process of attempting to recover all the winnings of this consultant, any unrecovered losses of affected players will be paid by Absolute Poker so that all affected persons will be made whole.
Next Steps
We are still investigating whether the consultant was acting alone or in concert with others, and it appears at this time that all account holders are innocent of collusion and were unaware of any wrong-doing by the consultant, who was immediately terminated. We continue to investigate this matter aggressively, and all of these preliminary findings are subject to the audits currently underway. We have recently uncovered additional accounts used by the consultant that have not been publicly reported. So as to not compromise the investigation, we are not releasing the names of these additional accounts at this time, and will contact these affected customers individually.
The specific allegations of unlawful activity are being investigated both by AP and by the authorized authorities, including the Kahnawake Gaming Commission. We will continue to actively cooperate with these authorities in full compliance with the Regulations Concerning Interactive Gaming. In addition to our own investigation and the audit by Gaming Associates, we have also submitted to an audit by the Kahnawake Gaming Commission.
Please be assured that we have corrected the problem that allowed the system to be unfairly manipulated. We are working furiously to increase the safeguards within our systems. While we are satisfied that our systems are secured, we realize that our security systems must be continuously monitored and enhanced.
Without question, this incident has been unfortunate for all concerned, and we will emerge as a stronger company. I realize it will take some time and much more information for AP to re-earn the trust and confidence of our customers who are in doubt of our commitment to the highest levels of security, privacy and integrity. As we move to address and correct this situation, our valued customers have played a vital role in uncovering this scheme through various online forums and have become an active part of the solution.
With my full sincerity, I thank you, and I promise to keep you updated as we bring this situation to a close.

They are also taking the following action and sending out the email below:
"We have started the process of refunds. All players will be refunded 100% - we are starting with the tournament players – who will all move up a place and also receive interest on their account. We will fully refund 100% of all ring and cash game players affected by the accounts in question too!"
Absolute Poker regrets to inform you that as a result of a security breach in our system, one player had access to an unfair advantage while playing the following poker tournament: ____________.
Absolute Poker has reimbursed to your poker account an amount to compensate you for potential losses resulting from this unfortunate incident.
Please be assured that we have corrected the problem that allowed the system to be unfairly manipulated. We remain committed to the highest levels of security, privacy and integrity.
This breach was exploited in several other tournaments and during some ring game play. We are in the process of auditing these records, and will pay for all losses suffered by the affected players in these other games as soon as these amounts are determined.
The unfair player has been deleted from the tournament standings. Accordingly, the amount that we have refunded to your account includes all of the following:
· The tournament buy-in;
· The tournament fee;
· Any additional prize amount that you are entitled to as a result of moving you up one tournament place if the unfair player finished in a spot higher than you; and
· Interest on the refund in the amount of 10% per annum.
We thank you for your continued support.

Mary I have to agree with you on this, and for anyone to continue to play on AP and think this was an isolated incident is a traitor. To play on a site that you know cheated players is crazy my mind. Just think, was this the only time? DOUBT IT! Was this the only site that could do this? DOUBT that too. GG AP

do you guys have any idea just how powerful the rake revenue model is by itself especially on a site doing the volume they are? You start a poker site for these very reasons versus a book or casino. YOu dont' care who wins or loses..your revenue as a poker site isn't contingent upon either and ideally you'd want your players to win just enough to keep playing more hands but not enough to ever really cash out and take money off the site. To think this was an added revenue stream is silly ,espeically given the risk of a company with this corporate structure and pressure from shareholders.
With over 1,000 employees...no question this was an inside job, but definitely isolated to one or two guys tops..any more then that this would have been exposed much sooner. Every company has a few bad eggs..and as I mentioned...various other ways the company could have taken money from the players in a much more subtle way then this....no question these were few, reckless and stupid employees who were like most criminals..eventually goign to get caught and usually becuase of their own stupidity.

No. Nor should anyone. Only the facts that they were so bold as to play "perfect post-flop play" and that an Absolute support employee was so bold as to send out all players' info was this ever brought to light.
Let's not let a few bad eggs ruin this poker site’s reputation.
Naw, Let's!!! Only significant lack of managerial oversight could allow someone with both access to superuser accounts and other sensitive information also run the fraud investigations, without several other employees being witness to either the security breach, the coverup, both, or more. The entire corporate structure is both guilty and can never be trusted.

company this big is far bigger then any one executive especially given
the shareholders and a board who manages companies like this. These are
not chop shop, wild west sport books operations of old operating in
costa rica anymore..these are massive companies very transparent today,
extremely corporate and up until a year ago..public or grooming to go
public with auditors and major financial institutions all over their
books.
Hmmm. The facts would say otherwise. Deep throat, who are you? You have 2 posts, but other than repeated grammatical errors, sound like a corporate representative. AP is obviously not transparent, nor HAD financial institutions all over their books.

Good point. How can we make sure this and other poker sites aren't doing this? A good topic of conversation for actual, constructive ways to ensure poker integrity.
Forget
just businesses..we have professional athletes (bonds) cheating
americas most loved games and cheating records that have stood for
decades..olympic athletes returning gold medals, the NFL
superbowl "Patriots" cheating with cameras on the sidelines....
"Everyone cheats, it's not so bad..." Right...that's why Bonds will be facing perjury and obstruction of justice charges, the same ones Clinton faced, though Clinton's original sin was with a cigar, and Bonds' with a needle (no allusion to actual body parts is intended). AP will face no such charges, as their denials and stonewalling was not vs. authorities, but the offenders WILL face fraud, theft, and unknown other charges. I also believe that the person who is officially the user of the IP address is legally on the hook for any fraud occurring on his internet account. At least this was the legal advice of one lawyer from Costa Rica.

we so almarmed that a tech business finally got hacked.
We are alarmed that they have gotten CAUGHT!!! With this, we now know that this has occurred before, not that it "finally happened." If someone with actual poker knowledge and just a bit of brains would do the same thing, they would easily get away with it, without any investigation. THAT is what is so alarming.
Btw, I object to the use of the word "hack" in this situation. The perpetrator used only tools that he had access to, and did not need to breach any software security measures in order to do what he did. The door was open for any person with his access to shed inhibition and morality and make an easy score. Why couldn't this have happened before at AP and others but done with more skill and better judgment? We all know now that this may be happening on a large scale.
As
much as this site has given away in promotions over the years and have
kept their nose clean, as long as they refund and prevent this from
happening again...
It's ok, they've donated much of their ill-gotten Malaysian sweatmill profits to the local Arts Fund. Hooray, what philanthropists. couldn't give a flyin' f__k. Put them in jail, hold all management in AP responsible for their complicity or negligence, and sell what's left of AP to a new group with no ties to either the gaming commission or the Mohawk tribe. I see no way for AP to salvage their company. Sell it or let it sink and have the other sites pick up their former clients.
Why do we want to save AP? We don't, we want clean internet poker, however we can do that.
In sum, this is a wake-up call for all internet poker. One way to ensure that more safeguards insue is to allow the market (players) to wave goodbye to AP, signalling that neither cheating nor managerial negligence that opens the door for such, IS NOT TOLERATED. Ciao, AP, thanks for the memories.

Chief Lots of Bucks gets on here makes an apology and everyone is suppossed to forgive them? the fact is they owe it to ALL of their members to make it public to the entire network! Not to just those who were cheated. IMO they provide a platform for which people play on. They are responable for providing a safe and secure enviorment. They are cheating everyone and this industry if they can not keep it safe. They are not protecting the average consumer by NOT MAKING this public. There is NOTHING on absolutepoker.com about this. I will forever get into all of their games and send people to this article. THIS IS BULLSHIT!!!!!!

LOL...This is the 1st thing that crossed my mind. A chief named "Joe Norton." I'm not too familiar with the names of any Chiefs or names of people on the Indian Reservation, but Joe Norton??
I also read stories about Mark Seif being involved. Somebody pointed out that they spoke with Mark and after looking into his eyes, that he was not lying. LOL. I hope you're not serious. Remember what Rafael Palmero, the baseball player told Congress?? "I have NEVER taken steroids!!! Never!!" How about the Olympic medalists when she said she has never taken HGH to help her performance!!! or
I believe Mark Seif could be involved in this whole mess. Why not?? Anybody with an opportunity to make ridiculous amounts of money without getting caught would jump on that opportunity!! Look at baseball with steroids and basketball with gambling. In the public's eye, you are guilty until proven innocent!!!

I take this Joe Norton as an honorable man. However, I think he should notify the police and at least try to get a warrant on the consultants and everyone involved so if they ever step foot in Canada or the US they are arrested. Also he should rehire the person who sent the spreadsheet. Also, this spreadsheet has ip's which is a violation of privacy. He should also pay for those who spent time and reputation on catching these guys. Also he should allow for review of the source code by the police of Canada.

Pfft...there is a police addage that goes something like "only the stupid criminals get caught". IN other words there are a lot of crimes committed by smart people that never get caught and/or go unpunished. Well AP got caught and they need to be punished.
PEOPLE....TAKE YOUR BUSINESS ELSEWHERE.
The fact that one dumb insider can get away with the management doing a cover act implies that other smarter insiders are doing it and are not getting caught with management "blessing".

Funny how the person that responded is a "former" employee yet owner. Nobody else would come forward. A refund is unacceptable compensation. There are punitive damages to the players as well. Like the time wasted playing a rigged tourney. Time wasted reading this dry unhealing document.
