My guess is neither side is going to get what they want very readily.  The time has passed for wide-scale enforcement of the law.  I doubt Kyl or Frank will be successful in getting what they want, which means (imo of course) that we'll be living/playing in the gray area for the forseeable future.

That's a possibility.  One good thing about us fighting back is that it helps us keep the status quo from getting worse.

 I think sometimes people forget that this "gray area" and status quo, is only existing through the hard work of the PPA and people like TheEngineer.  Bob Goodlatte promised a bill in 2007 that would finish what UIGEA started, and he wasnt lacking in support at the time either.  Momentum for that bill and other laws to strengthen the UIGEA has been stopped dead in its tracks.
