My candidate for the most uninformed thread ever. The DOJ blocked Neteller's access to the ACH network... spin that however you'd like, but they effectively shut them down to us residents.

Agreed, although there is a lot of money at stake here, and the DOJ probably wants to develop some case law for future use. Legally, the money laundering charges are big trouble for these guys. I wouldn't be at all surprised if they try to cut a deal.

They can't, unless the money is actually in the US. My guess would be that they seized some money that a few big affiliates were transferring from Neteller to banks in the US. Either that, or the writer of the article got confused and meant Bet on Sports when he said Neteller.

My guess is that the poker companies and payment processers are panicking from an operational perspective because they in fact have a large number of employees who work inside the United States. I am also guessing that nobody has brought an action thus far because they were waiting to see if the government was serious about enforcing the law. As long as they still got business, they were content to play wait and see. That may be over now. I think your instincts are right on a legal strategy, but the problem is how to test the law. Operating an online sportsbetting business in the US is illegal according to U.S. law. Enabling the transfer of money to an illegal business is also illegal. The government did not mention poker in their indictment, so it is unlikely that this will serve as a test case. Make no mistake about it, this is a horrible development for online poker players. If Neteller leaves the US market, as I expect they will do, a lot of dead money is going to stop playing online.

They're not just being charged with RICO. They're going to be charged under the Wire Act as well. And any good attorney should have been able to tell them that being "out of the business" is no protection -- as long as the statute of limitations has not run, they can be charged.

The thing that baffles me is why these guys felt so comfortable living and traveling in the United States. Anybody with a lot of seizeable assets who started or runs gambling businesses should not be going near the United States right now.

Speaking as an attorney and based on my reading of the complaint, it appears that they are going to charge them with conspiracy to violate the wire act, money laundering, and perhaps RICO. The government specifies that the "unlawful gambling activity" that Neteller enables is sportsbetting. I would like to say that many people on these boards are upset, but that as a strict legal matter, the government probably has a good case against these guys. I am an attorney, and I will contradict what a lot of people are saying on here. I think you should be able to recover. File against him in small claims court in Pennsylvania ($5,500 is not too much). I would frame your loan as a straightforward loan that just happens to be via the internet. The more you can make it look like a normal loan, the better off you will be, because courts won't enforce "illegal" contracts. The filing fees are a little pricey (a few hundred bucks) but worth it if you aren't going to recover the money any other way. If you get a judgement against him, the rest is ...

Stop denying reality. The Republican party is in the service of the religious right, and the religious right wants to prohibit you from playing poker, both live and online. Individual democrats like Ford might have voted for the legislation, but Democrats as a whole would not try to appease religious conservatives. A vote for a Republican in this election is a vote in support of the Republican congressional leadership, which just engineered the online gaming bill. This is not debatable. This is fact. Calling here and playing a flop is absolutely horrid. And saying "for me, this is an easy fold" seems rather silly too. The question is not whether this is an easy fold for your typical ABC player. The question is: is this an easy fold for foshio, given what he is capable of doing with 60k in chips at this stage in a live tournament (this was not online). Regardless of where you come out, this is nowhere close to an "easy fold."

This may all be true, but it doesn't explain why Party Poker was running ads on Oprah while the Senate was taking the measure up. I suspect when the sites look back, they will wish they had stayed more low profile and spent a lot more money on good lobbyists.

I really tend to disagree that we did our best to stop this. This is not the mods fault, but most of the people on here, as well as 2+2, NWP, etc, had their heads in the sand. I never counted more than 100 people at a time viewing the 2+2 poker legislation forum until friday night, when there were 1500....
