I 100% agree with El Burro. I've had both. DirecTV is a better product but their customer service is terrible. There is no way DirecTV will get anymore of my money.

Yes, because while you might be an amazing drunk/texting/drowsy driver, a substantial portion of the population is not and those individuals place the lives of other individuals in danger on a daily basis. Those individuals should be outlawed from doing the above and as we all know, we can't have drunk driving ok for one segment of the population and not for another. Im sorry that your "right" to drive drunk is curtailed by the actions of other.

Dyz we arent talking about one kid blowing up his hand therefore we outlaw all fireworks. We are talking about substantial numbers of accidents caused by drunk driving. Of course we don't outlaw drinking a soda in the car because you have to look down to put it in the cup holder and that can decrease reaction time. But it is obvious that some actions like drinking and driving and texting while driving substantially increase the likelihood of serious harm against another individual. I think you guys need to look at whether length of sentence is a deterrent to criminal behavior. Yes, all other traffic laws are followed. The problem is that drinking and driving isnt a victimless crime. It substantially increases the chances of an accident.

I should have phrased it better and said that under the law etc...I dont agree with special needs searches. Im just like you :-) And the only reason I cite the "special needs" stuff is because I teach criminal procedure at a local university and these issues come up alllllllllllllllllllllllllllllllllllllll the time. So I was forced to learn the Courts rationale behind them.

Courts use the "reasonableness" clause of the 4th Amendment to answer your question. They say that special needs searches are reasonable under the 4th amendment. The same way they use the "reasonableness" clause of the 4th Amendment to say that stop and frisk is ok under a standard of reasonable suspicion instead of probable cause.

DYZ: The reason the Supreme Court has held these types of intrusions constitutional is because of an exception to the 4th Amendment warrant requirement called "special needs" searches. These searches are not designed to investigate illegal behavior but instead to protect public safety. The same rationale is used for TSA scanners, border searches, high school drug testing, etc etc etc.... The correct answer has already been said in this thread. The police did not allow him to leave because he has a right not to answer their questions. They allowed him to leave because his behavior lead them ...

SCOTUS Rules GPA Tracking Requires Warrant
The rationale given by the Court is that the 4th Amendment is supposed to protect "intimate activities" and your activities that you open up to the public (like driving down the road or talking on your cellphone in public) are less intimate than the home. The same rationale is used when the Court determined that "open fields" do not enjoy 4th amendment protection, even if they are fenced off with no trespassing signs.

In the sense that while you are driving your car you are essentially broadcasting your private actions in a public manner. It would not be unconstitutional for the police to tail a person 24/7 as a way to track activities. I can see an argument that you "assume the risk" when you open up your actions to 3rd parties. For example, you cannot speak in a private setting in earshot of a third party and assume your conversation will remain private.

Dyz: if you agree with a property rights approach then would you overturn Katz' FWIW I teach constitutional criminal procedure at a local university and cannot wait to talk about this on Wednesday. Especially since I just got done telling my class last week that a warrant was not required to GPS vehicles. I'm not sure I agree with the Court on this one.

Republican primaries
Prediction: RP gains enough support throughout the primaries to have a central speaking slot at a brokered RNC. RP threatens 3rd party run against Romney/Obama. Romney offers RP his choice of Chairman of the Fed or Secretary of the Treasury. RP accepts. Not sure which one he takes though.

Don't forget that Paul will draw Dems and Independents while Santorum and Romney will not. What's different about Iowa VS other states is that in Iowa you can register to vote AT the caucus, which I'd assume helps Paul more than anyone. If Santorum wins, my faith in an intelligent electorate is over.

The idea of indefinitely detaining US citizens without even the slightest amount of due process is beyond absurd. And Obama's own statements regarding not using it for that are hypocritical. He already has authorized missile strikes against US citizens without due process.
