Those individuals should be outlawed from doing the above and as we all know, we can't have drunk driving ok for one segment of the population and not for another. We are talking about substantial numbers of accidents caused by drunk driving. Of course we don't outlaw drinking a soda in the car because you have to look down to put it in the cup holder and that can decrease reaction time. But it is obvious that some actions like drinking and driving and texting while driving substantially increase the likelihood of serious harm against another individual. Im just like you :-) And the only reason I cite the "special needs" stuff is because I teach criminal procedure at a local university and these issues come up alllllllllllllllllllllllllllllllllllllll the time. They say that special needs searches are reasonable under the 4th amendment. The same way they use the "reasonableness" clause of the 4th Amendment to say that stop and frisk is ok under a standard of reasonable suspicion instead of probable cause. Posted in: Off Topic |

Guy says FU to a DUI checkpoint like a boss DYZ: The reason the Supreme Court has held these types of intrusions constitutional is because of an exception to the 4th Amendment warrant requirement called "special needs" searches. These searches are not designed to investigate illegal behavior but instead to protect public safety. The same rationale is used for TSA scanners, border searches, high school drug testing, etc etc etc.... The correct answer has already been said in this thread. The police did not allow him to leave because he has a right not to answer their questions. They allowed him to leave because his behavior lead them ... Posted in: Off Topic |

SCOTUS Rules GPA Tracking Requires Warrant The rationale given by the Court is that the 4th Amendment is supposed to protect "intimate activities" and your activities that you open up to the public (like driving down the road or talking on your cellphone in public) are less intimate than the home. SCOTUS Rules GPA Tracking Requires Warrant In the sense that while you are driving your car you are essentially broadcasting your private actions in a public manner. It would not be unconstitutional for the police to tail a person 24/7 as a way to track activities. I can see an argument that you "assume the risk" when you open up your actions to 3rd parties. Republican primaries Prediction: RP gains enough support throughout the primaries to have a central speaking slot at a brokered RNC. RP threatens 3rd party run against Romney/Obama. What's different about Iowa VS other states is that in Iowa you can register to vote AT the caucus, which I'd assume helps Paul more than anyone.
