PPA Files Amicus brief in South Carolina Poker Case
For those of you interested, I am providing a link to the Amicus brief the PPA has filed on behalf of those involved with the current poker case in South Carolina. I also have to caution about Bekigirl's post. This is the law that was passed two years ago. This isn't something new. These are the regulations of that law, many of which were never actually enforced or put into place. The major problem all comes down to the overblocking clause in the regulations. Banks that don't enforce the law enough will face penalties, Banks that over-enforce the law, and block things that are clearly not illegal by law in many states, like Internet Poker say in CA, will face absolutely no recourse for blocking what is a perfectly legal transaction. At this point, it is still unclear. The rule was finalized today. The Dec 1 date is the last day banks and institutions can operate without fear of punishment for violating or not enforcing this rule. My take is that they will begin to enforce it much much sooner. But like I said before, the situation is still fluid. I will post as much information as possible both here and on the PPA website, . More detailed information will emerge in a few days, we have heard that the OMB made some big changes to the Regs before they were finalized, so we are really just waiting to see what they look like. Update: It looks like Tom Perriello will squeak out a win of less than 100 votes over Virgil Goode which is simply an amazing win for us, being that Tom Perriello was not expected to compete, let alone win, as he was significantly underfunded, took no PAC money and was up against a strong incumbent in a formerly Republican district. This is all unofficial of course. Thelma Drake is also done, that race has been called for Nye, and she was counted in that email about the 9 people on the Leach list who have already been defeated. Tuesday's Election and what it meant for Internet Poker
In the words of Ron White, "It was a good day Tater". First the bad news. We lost two good Republican Allies, Sen John Sununu of NH and Rep Jon Porter of NV. We also lost a Democratic Supporter in Rep Don Cazayoux. The good news. 9 of the 30 Members of the Leach list lost, and 2 more Leach list members are in races that are still too close to call. In the Senate, F rated Senators Elizabeth Dole (NC) and Gordon Smith (OR) both were defeated by there challengers. In New Mexico, Rep Tom Udall won the open Senate seat by a wide margin. Cliff Notes: This bill will force the UIGEA to only go into effect for Sports betting only, which is already illegal under the wire act. It will be give us months to years of time to work without fear of the US market being closed to Internet poker. Still lots of work to be done. The bill now goes to a vote from the full house. If it passes, then it will be done in the Senate, and then must be signed into law by the President. However, this bill alone existing will force the regulators to respect it.
