oh let's come off the high horse for one minute. the cardinal written rule in the big ten, and every other major conference, is WIN. anything it takes, within NCAA rules. when a coach sees a man like Tubby Smith, who won 77% of his games at Kentucky, get forced out for not winning enough, doesn't it put pressure on that coach to do whatever is necessary to get the best players' college basketball is cutthroat, there are no "unwritten rules" about who you may or may not recruit.

a quick lesson in delegation of federal powers. The 16th Amendment gives the federal government (Congress) the power to tax income. Congress delegated its power to tax income to the IRS. The essential flaw in the argument is that it assumes that only profits may be taxed. In certain situations (sales of capital assets, for example) that is the way our tax code works. But the 16th Amendment gives Congress the power to tax income, that is, any money that a person takes in, not just profits. Just because Congress chooses to exercise its power in different ways in different cases does not imply that it may not tax all personal income. Frankly it is a waste of all of our tax dollars for the taxpayer to push this frivolous argument into court.

because he can neither read nor synthesize information, apparently. the line of cases upholding the constitutionality of the federal income tax is long and unbroken. if a judge cannot or will not faithfully apply that line of cases when a similar case is brought before him, he is unqualified to hold judicial office.

jury verdicts are every bit as appealable as judicial findings of fact and law. Findings of fact are upheld unless clearly erroneous. (they are clearly erroneous, here). Conclusions of law are reviewed de novo (i.e., the appeals court takes a fresh look at any legal conclusions the judge made, and evaluates them independently). The taxpayer's argument is clearly a loser. Someone has already posted the 16th Amendment in this thread. That should have ended it.

if you make broad-brush generalizations based on one specific statement, you commit a logical fallacy. I said people who think Ripken is overrated do not know anything about baseball. I stand by that 100%. What I said is quite different from saying that anyone who disagrees with me on any topic does not know anything about that topic.

this is a running joke on the Jim Rome Show, stemming back to a caller many years ago who claimed Ripken was overrated, that his record was stupid, and that he wanted to pay a million dollars to spray Ripken in the face with pepper spray. if you think Cal Ripken is overrated you know nothing about baseball. it's that simple.

if you ever went to a frat party and were dumb enough to drink from a communal alcoholic beverage, you probably deserve what you got. some of my closest friends were in frats in college, and are outstanding individuals. but many frat guys are raging dickheads who get off on degrading others in order to establish that "special lifelong bond." my personal opinion is that there were more of the latter than the former.
