The general rule, called the parole evidence rule, is that you cannot go beyond the written agreement to add to or change the written agreement, but there are several exceptions, ambiguity being one of them. If a term or provision is ambiguous, even after extrinsic evidence, then the general rule is that the language is to be construed against the drafter of the agreement, usually the employer. I would not assume the employer would not want to test it. If the employee were my client I would have him clear his place of residence with the employer before he moved (or bought the house). If he ...

In Michigan it might be road miles.: "In this case, I conclude that the proper interpretation of MCL 15.602(2) accords with the latter context and therefore must be in “road miles.”   Typically, employees must travel to and from work along public roadways (particularly if they reside 20 or more miles from their place of employment).   Accordingly, the Legislature must have intended a measurement along the course of the highways". But this case was in a certain context determining a statutory provision relating to a collective bargaining agreement. Apparently there is no easy ...

more serious answer: It could depend on the purpose of the limitation, who drafted the contract or there could be other evidence (extrinsic evidence) that shows what the answer is. With no other information, I go with, "as the crow flies".

Nobody's taking away the right to have a dozen Cokes, if that's what you really want. Just please don't give yourself heart disease or diabetes, because my health premiums are already high enough. Government makes decisions all the time about food cleanliness and drug safety that are far more limiting; this proposal seems more on the order of a sensible suggestion than choice-destroying coercion.

At least it’s a start to help the people no one else cares about, who are in desperate need of stewardship. Left to our own devices, we will almost always make the more comfortable and sometimes wrong choice. No one needs over a quart of soda. I’m not big on setting up a Nanny state, but I also see that we can’t rely on ourselves to make good choices. In the end - even if it’s just a start, curbing obesity is a noble goal. We need to start thinking for the long term, not just what looks like a good idea(or comfortable idea) now. This is not a republican or democrat issue - it’s a ...

It's really cool to mock the anticipated responses to this sort of thing. It would be a fucking stupid law. It also embodies an attitude about the relationship between government and individuals that carries over into far more important aspects of that relationship. The way I see it, your problem is that you look at these issues solely from the impact on your life and determine if it is a big deal to you with no regard to the principle. Nothing new here. How's that'

The Julian Assange Show: Occupy Movement
This thread is kind of weird in that we have the Obama supporters also taking the position that Assange is a hero for exposing deep dark secrets of our intelligence-industrial complex and Obama haters taking the position that Assange is a criminal hacker who should be punished, yet it is Obama who is pursuing him criminally. No criticism of Obama and the DOJ here' Really' The other notable thing is the ones cheering on the exposing of our government misdeeds are the same as the ones who trust it implicitly with the economy and social issues. I guess I don't get how one can be be so ...

Can my employer do this?
You should out find how your bonus is calculated. Your question is whether you were over paid or not. If you were over paid through an error then yes, they probably can take it out of your pay. If not, then they can't.

Equal work equal pay!
One question I have is whether the sponsors of this bill or any supporters of it would be in violation of it's provisions, if it were passed. Another question is whether there is some exemption for Congress.

Being a spy is a dangerous business. I have no idea as to the facts of this situation or even what happened to him. I also have no idea how the legal system in Pakistan works. I just wanted to say that being a spy is a dangerous business. Didn't some blind guy escape from Chinese government recently.

Serious Dilemma (wsop Vegas Related) ...
Here's the thing. Only you know how much you care for this girl. You write a few things in your post about her and that's great, but the answer to your "dilemma" lies in how much you care about her. If you were already married or were getting married in the near future you would not be making this post. If she was your junior bacon cheeseburger, you would not be making this post. Obviously you are somewhere in between. Only you know where you are. This much is true. If she cares about you and you go you will cause irreparable harm to the relationship. If she doesn't and you go no big ...

The result is a bottle coated with "LiquiGlide," a non-toxic material so slippery that the ketchup or for that matter mayonnaise just glides out when you turn it over".
